Every cigar smoker knows the brand name of Cohiba. It is a brand associated with excellence, great cigars, and unfortunately for Americans, Cohiba is a Cuban brand.
Cohiba is originally a brand made by Cubatabaco, which is owned by the Cuban Government. For over ten years though, General Cigar, an American company, has been selling ‘Cohiba’ cigars in the United States.
The legal dispute has arisen because General Cigar has trademarked Cohiba in the US, but there is an existing law that states well known brands are acknowledged in the US even if they are not officially registered here.
Recently, Manhattan Federal District Court Judge Robert Sweet enjoined General Cigar from using the Cohiba name. But Judge Sweet also stayed the injunction pending General Cigar’s appeal.
If General Cigar loses the appeal, it is possible that there could be no more ‘Cohiba’ cigars in the United States legally.
